National drug strategy & laws
The Czech Republic is the only post-communist country to have strongly reduced punishments for some drug-related activities. The production and sale of drugs have always been punishable under Czech criminal law. The possession of drugs was decriminalized after the collapse of the Communist regime, but penalties were reinstated in 1999 for possession in amounts classified as “larger than small.” The new Criminal Code enacted in 2009 differentiates between cannabis and other drugs and imposes less strict penalties for the use and cultivation of cannabis. The use of cannabis for medical purposes was legalized in 2013.
The fundamental pillars of the Czech Republic’s Drug Policy are: primary prevention, treatment, social integration, harm reduction, risk minimization, and drug supply reduction. Today these appear to be obvious choices, but it was necessary to see the failure of a previous policy to realize that.
The Criminal Code, which has been in force since 2010 (Act 40/2009), is the major act covering drug-related offences in the country, although minor offences are addressed under the Act on Violations (Act 200/1990). The lawful handling of narcotic drugs and psychotropic substances and precursors is subject to regulation in accordance with the Addictive Substances Act (Act 67/1998).
Drug use is not an offence in Czech Republic, and the cultivation or possession of small quantities for personal use is a non-criminal offence under the Addictive Substances Act.
National treatment policy
The implementation and coordination of the Czech drug policy take place at two domestic levels, central and regional, in which the public health system plays a fundamental role, offering treatment and rehab services.

Treatment-related objectives in the Czech National Drug Policy Strategy 2010-18 and its action plans place an emphasis on enhancing the availability and quality of drug treatment services, as well as supporting the social rehabilitation of people who use drugs in the country.
